Competition Terms and Conditions
The following terms and conditions apply to all Schiavello competitions. Participation in a Schiavello competition is deemed acceptance of these terms and conditions and all entries must comply with these terms and conditions to be valid.
Entry
Information on how to enter, prizes to be won and duration are contained in the promotional brochure provided to you.
Unless otherwise stated in these terms and conditions, no person may enter a competition more than once and persons may not enter or participate on behalf of any third party.
All correct and valid entries submitted during the promotional period specified in the promotional brochure, will be entered into the prize draw to win the nominated prize.
All entries become the property of Schiavello. Entries not completed in accordance with conditions of entry as outlined in the promotional brochure or received after the closing date will not be considered. Schiavello accepts no responsibility for any late, lost or misdirected entries not received by Schiavello for any reason.
Schiavello reserves the right to verify the validity of entrants and entries. Schiavello reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these terms and conditions.
Prize Conditions
Prizes are non-negotiable, non-transferable and cannot be redeemed or exchanged. In the event that the nominated prize is unavailable, Schiavello reserves the right to substitute a different prize of equivalent value in its place.
Notification of Winners
Winners will be notified by email or mail.
Collection of Prize
Competition winners will be required to collect their prize from the Schiavello office stipulated in the promotional brochure. Schiavello reserves the right to request winners to provide proof of identity and proof of entry in order to claim a prize.
Prizes which are unclaimed after a period of one month from the date the winner is notified will be forfeited.
Release and Indemnity
To the extent permitted by law, all entrants release from, and indemnify Schiavello against all liability, cost, loss or expense arising out of acceptance of any prize or participation in the competition including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property, whether direct or consequential, foreseeable due to an act or omission or otherwise.
Schiavello makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, Schiavello is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by Schiavello or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under legislation. To the full extent permitted by law, any liability of Schiavello or its employees or agents for breach of any such rights is limited to the payment of the cost of having the prizes supplied again.
Termination of Competition
If for any reason a competition does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failure or any other cause beyond Schiavello’s control that corrupts or affects the administration, security, fairness, integrity or proper conduct of a competition, Schiavello reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition, subject to state regulations.
Schiavello may vary the terms or terminate a competition at any time at its absolute discretion without liability to any entrant or other person.
Decisions Final
All decisions and actions of Schiavello relating to a competition and /or redemption of prizes are exercised according to Schiavello’s absolute discretion and are final and binding on every entrant. No discussions or correspondence with entrants or any other person will be entered into.
Personal Information and Privacy
The personal information supplied by entrants when entering competitions will be used by Schiavello in accordance with its privacy policy which can be located on the Schiavello website. The personal information collected as part of the entry is collected to enable identification of the winner and for future marketing and promotional purposes. Your personal information will only be disclosed to Schiavello and its related bodies corporate for these purposes.
Waiver
Failure by Schiavello to enforce any of its rights in accordance with these terms and conditions does not constitute a waiver of those rights.
